1. Aceptación de los términos

Al descargar, instalar o usar la aplicación Tikk ("la App"), usted acepta estos Términos y Condiciones en su totalidad. Si no está de acuerdo con alguna parte de estos términos, no debe usar la App. Tikk se reserva el derecho de modificar estos términos en cualquier momento, y su uso continuado constituye la aceptación de dichas modificaciones.

2. Descripción del servicio

Tikk es una plataforma móvil que permite a los usuarios descubrir actividades y destinos turísticos en Colombia. La App ofrece funciones como exploración por cuadrícula, modo swiper, mapa interactivo, seguimiento de lugares visitados, lista de deseados e insignias de logros.

3. Registro y cuenta

  • Debe tener al menos 13 años para crear una cuenta.
  • Usted es responsable de mantener la confidencialidad de sus credenciales de acceso.
  • La información proporcionada durante el registro debe ser precisa y actualizada.
  • Una cuenta por persona. No se permiten cuentas duplicadas.
  • Tikk puede suspender o eliminar cuentas que violen estos términos.

4. Plan gratuito y Tikk Pro

4.1 Plan gratuito

El plan gratuito incluye acceso a la exploración de actividades, el modo swiper, y la posibilidad de marcar hasta 12 actividades como visitadas o deseadas.

4.2 Tikk Pro (suscripción premium)

  • Precio: 54.000 COP por año.
  • Incluye: marcas ilimitadas, mapa de aventuras completo, acceso a actividades en Colombia, México y Perú, e insignias exclusivas.
  • Facturación: la suscripción se procesa a través de Apple App Store o Google Play Store según su dispositivo.
  • Renovación: la suscripción se renueva automáticamente al final de cada período, a menos que se cancele al menos 24 horas antes.
  • Cancelación: puede cancelar su suscripción en cualquier momento desde la configuración de su tienda de aplicaciones. La cancelación es efectiva al final del período de facturación vigente.
  • Reembolsos: los reembolsos se gestionan según las políticas de Apple App Store o Google Play Store.

5. Uso aceptable

Al usar Tikk, usted se compromete a no:

  • Usar la App para fines ilegales o no autorizados.
  • Intentar acceder a cuentas de otros usuarios sin autorización.
  • Interferir con el funcionamiento de la App o sus servidores.
  • Realizar ingeniería inversa, descompilar o desensamblar la App.
  • Publicar contenido ofensivo, difamatorio, discriminatorio o ilegal.
  • Usar bots, scrapers u otros medios automatizados para acceder a la App.
  • Suplantar la identidad de otra persona o entidad.

6. Propiedad intelectual

  • La App, su diseño, código, contenido, marcas, logotipos e iconos son propiedad de Tikk y están protegidos por leyes de propiedad intelectual.
  • El contenido de actividades (fotos, descripciones, datos) es propiedad de Tikk o de sus licenciantes.
  • Usted no puede copiar, modificar, distribuir o usar comercialmente ningún contenido de la App sin autorización escrita.
  • Al subir contenido (fotos de perfil, reseñas), usted otorga a Tikk una licencia no exclusiva para usar dicho contenido dentro de la plataforma.

7. Contenido y precisión

Tikk se esfuerza por proporcionar información precisa sobre actividades y destinos. Sin embargo, no garantizamos la exactitud, integridad o actualidad de toda la información. Las condiciones de los destinos (horarios, precios, accesibilidad) pueden cambiar sin previo aviso. Recomendamos verificar la información directamente con los destinos antes de visitarlos.

8. Limitación de responsabilidad

  • Tikk se proporciona "tal cual" y "según disponibilidad".
  • No somos responsables de daños directos, indirectos, incidentales o consecuentes derivados del uso de la App.
  • No garantizamos el funcionamiento ininterrumpido o libre de errores de la App.
  • No somos responsables de la seguridad o condiciones de los destinos listados en la App.
  • Tikk no se hace responsable de las experiencias del usuario en los destinos ni de eventos que ocurran durante sus viajes.

9. Disponibilidad del servicio

Tikk puede estar temporalmente no disponible por mantenimiento, actualizaciones o circunstancias fuera de nuestro control. Nos reservamos el derecho de modificar, suspender o descontinuar cualquier función de la App en cualquier momento, con o sin previo aviso.

10. Terminación

Podemos suspender o terminar su acceso a la App si viola estos términos. Usted puede eliminar su cuenta en cualquier momento desde la configuración de la App. Al terminar, perderá acceso a su historial de actividades, insignias y beneficios de suscripción activa.

11. Ley aplicable

Estos términos se rigen por las leyes de la República de Colombia. Cualquier disputa se resolverá ante los tribunales competentes de Colombia, de acuerdo con la legislación vigente.

By downloading, installing, or using the Tikk application ("the App"), you agree to these Terms and Conditions in their entirety. If you do not agree with any part of these terms, you should not use the App. Tikk reserves the right to modify these terms at any time, and your continued use constitutes acceptance of such modifications.

2. Description of Service

Tikk is a mobile platform that allows users to discover tourist activities and destinations in Colombia. The App offers features such as grid exploration, swiper mode, interactive map, visited places tracking, wishlist, and achievement badges.

3. Registration and Account

  • You must be at least 13 years old to create an account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • Information provided during registration must be accurate and up to date.
  • One account per person. Duplicate accounts are not permitted.
  • Tikk may suspend or delete accounts that violate these terms.

4. Free Plan and Tikk Pro

4.1 Free Plan

The free plan includes access to activity exploration, swiper mode, and the ability to mark up to 12 activities as visited or wished.

4.2 Tikk Pro (Premium Subscription)

  • Price: 54,000 COP per year (~$12 USD).
  • Includes: unlimited marks, full adventure map, access to activities in Colombia, Mexico, and Peru, and exclusive badges.
  • Billing: the subscription is processed through Apple App Store or Google Play Store depending on your device.
  • Renewal: the subscription auto-renews at the end of each period unless canceled at least 24 hours before.
  • Cancellation: you can cancel your subscription at any time from your app store settings. Cancellation takes effect at the end of the current billing period.
  • Refunds: refunds are handled according to Apple App Store or Google Play Store policies.

5. Acceptable Use

When using Tikk, you agree not to:

  • Use the App for illegal or unauthorized purposes.
  • Attempt to access other users' accounts without authorization.
  • Interfere with the operation of the App or its servers.
  • Reverse engineer, decompile, or disassemble the App.
  • Post offensive, defamatory, discriminatory, or illegal content.
  • Use bots, scrapers, or other automated means to access the App.
  • Impersonate another person or entity.

6. Intellectual Property

  • The App, its design, code, content, trademarks, logos, and icons are the property of Tikk and are protected by intellectual property laws.
  • Activity content (photos, descriptions, data) is owned by Tikk or its licensors.
  • You may not copy, modify, distribute, or commercially use any App content without written authorization.
  • By uploading content (profile photos, reviews), you grant Tikk a non-exclusive license to use such content within the platform.

7. Content and Accuracy

Tikk strives to provide accurate information about activities and destinations. However, we do not guarantee the accuracy, completeness, or timeliness of all information. Destination conditions (hours, prices, accessibility) may change without notice. We recommend verifying information directly with destinations before visiting.

8. Limitation of Liability

  • Tikk is provided "as is" and "as available".
  • We are not liable for direct, indirect, incidental, or consequential damages arising from the use of the App.
  • We do not guarantee uninterrupted or error-free operation of the App.
  • We are not responsible for the safety or conditions of destinations listed in the App.
  • Tikk is not responsible for user experiences at destinations or events that occur during their travels.

9. Service Availability

Tikk may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any feature of the App at any time, with or without notice.

10. Termination

We may suspend or terminate your access to the App if you violate these terms. You may delete your account at any time from the App settings. Upon termination, you will lose access to your activity history, badges, and active subscription benefits.

11. Governing Law

These terms are governed by the laws of the Republic of Colombia. Any disputes shall be resolved before the competent courts of Colombia, in accordance with current legislation.
